ISLAMABAD: The Islamabad High Court (IHC) has directed the Capital Development Authority (CDA) to decide within one month on the long-pending applications of affectees from Shah Allah Ditta and Sector C-13.
Justice Mohsin Akhtar Kayani issued the directive during the hearing of petitions filed by the affected residents, while also rejecting a separate application that sought to stop the transfer of CDA Deputy Commissioner Sardar Muhammad Asif — a senior official currently serving on deputation as Senior Special Magistrate.
Sardar Muhammad Asif was originally posted in the CDA on deputation for three years, which was later extended for another two years. His five-year tenure has already expired, but a new summary has reportedly been moved by the city managers seeking his further retention in the civic body. Known for his bold decisions as Senior Special Magistrate, Sardar Asif is credited for holding several influential figures accountable for violations of municipal laws — a rare practice in the past.
During the hearing, Justice Kayani expressed displeasure over the plea seeking to halt his transfer, observing that it was not the court’s role to recommend or protect any individual officer. “The court has no sympathy for any official — they are public servants, and no one is indispensable,” he remarked.
When the petitioner’s counsel urged the court to stop Sardar Muhammad Asif’s transfer until a final decision on the case, Justice Kayani rebuked the request, asking, “Are you here to pursue your case or to save an officer’s job?”
“You are asking the court to make a recommendation for an officer — why shouldn’t I send this matter to the Prime Minister since you appear to be seeking favours?” the judge remarked sharply.
He further stated that if an officer is going on deputation, they should be allowed to proceed. “Such matters should not be discussed in court. Those who want to work should do their job, and those who don’t should go home,” Justice Kayani added.
After rejecting the application regarding Sardar Asif’s transfer, the court directed the CDA to decide the C-13 affectees’ applications within one month.
The case was adjourned until next month.
