Authority issues final notice, warns of cancellation and demolition for non-compliance
ISLAMABAD – In a major regulatory move, the Capital Development Authority (CDA) has issued a final show cause notice to Bahria Town (Pvt) Ltd over serious violations in its Bahria Paradise Commercial schemes located along GT Road, Zone-5, Islamabad. The notice cites non-payment of Rs1.842 billion in commercialization fees and unauthorized constructions without CDA approval, warning that continued non-compliance could lead to cancellation of layout plans and demolition of illegal structures.
Located at the main entrance of Bahria Town Phase-4, Bahria Paradise Commercial is among the most sought-after mixed-use business districts in the twin cities, featuring projects such as Galaxy Mall, Melrose Arch, Beacon One, Beacon Two, and The Heritage. The zone houses a mix of shopping malls, offices, and high-end apartments that attract both local and overseas investors.
According to the notice, Bahria Town has failed to deposit the required Rs1.842 billion in land use conversion charges despite multiple reminders issued since 2023. The authority also imposed additional fines exceeding Rs60 million for initiating construction without obtaining mandatory No Objection Certificates (NOCs), layout approvals, and mortgage submissions.
The CDA has instructed Bahria Town to clear dues and submit all pending documentation within seven days, failing which the civic body may proceed with layout plan cancellation and enforcement action under the CDA Ordinance 1960 and the ICT (Zoning) Regulations, 1992.
Officials and market observers view this action as part of a broader crackdown and legal follow-up against Bahria Town and its chairman Malik Riaz, with CDA and other government departments tightening oversight of housing and commercial schemes allegedly developed without full regulatory compliance.
Citing previous judgments of the Islamabad High Court (2018) and Supreme Court of Pakistan (2018), the CDA reiterated that any construction undertaken without lawful authority is deemed illegal and subject to demolition. It also warned that any attempt to resume construction on sealed premises would amount to contempt of court.
A senior CDA official told Infra News PK that the authority has shown maximum leniency in the past but this notice marks the final opportunity for Bahria Town to comply. “If the developer fails to settle the dues or regularize the violations, enforcement will begin,” the official said.
